Fishkeeper App Exclusive Promotions - Terms and Conditions

These Terms and Conditions apply to all promotional offers, discounts, vouchers, rewards, campaigns and incentives made available exclusively through the Fishkeeper App (‘App Promotions’).

By downloading, accessing and using the Fishkeeper App and redeeming any App Promotion, you agree to be bound by these Terms and Conditions.

1. Availability of promotions

1.1 App Promotions are available exclusively through the Fishkeeper App.

1.2 The Fishkeeper App can be downloaded from the Apple App Store and Google Play Store.

1.3 Promotions may be offered on selected dates, for limited periods, as part of specific campaigns, or to selected groups of customers.

1.4 Full details of each promotion, including qualifying products, discount values, redemption limits, participating stores and expiry dates, will be displayed within the Fishkeeper App.

1.5 Maidenhead Aquatics reserves the right to vary, suspend, withdraw or cancel any App Promotion at any time without prior notice.

2. Accessing promotions

2.1 Eligible promotions may be displayed as notifications, pop-ups, banners, vouchers, rewards or other promotional content within the Fishkeeper App.

2.2 Promotion details, including qualifying products, discount values, redemption limits and expiry dates, will be displayed within the App.

2.3 Customers are responsible for ensuring they have downloaded the latest version of the Fishkeeper App and have access to their account at the time of redemption.

2A. Fishkeeper account requirement

2A.1 App Promotions are available only to customers who have downloaded the Fishkeeper App and are logged into a valid Fishkeeper App account.

2A.2 Customers must be signed into their Fishkeeper App account at the time of redemption and be able to display the live voucher associated with that account.

2A.3 Vouchers are linked to the individual account to which they are issued and may only be redeemed by the account holder.

2A.4 Customers may be asked to provide reasonable verification of account ownership where misuse is suspected.

2A.5 Maidenhead Aquatics reserves the right to refuse redemption where there is reason to believe a voucher has been shared, transferred, duplicated, accessed through another person's account or otherwise used contrary to these Terms and Conditions.

2A.6 Creating multiple accounts to obtain additional promotional benefits, circumvent redemption limits or exploit App Promotions is prohibited. Maidenhead Aquatics reserves the right to cancel promotions, suspend accounts or refuse redemption where such activity is suspected.

2A.7 If a customer is unable to access their Fishkeeper App account at the time of purchase, including due to forgotten login credentials, device issues or connectivity problems, Maidenhead Aquatics is under no obligation to honour the promotion.

2A.8 App Promotions have no cash value, remain the property of Maidenhead Aquatics and may be withdrawn from an account where fraud, misuse or breach of these Terms and Conditions is suspected.

3. Voucher redemption

3.1 To redeem an App Promotion, customers must present the valid voucher within the Fishkeeper App on a compatible smartphone or tablet device at the time of purchase.

3.2 Staff may be required to scan a barcode, QR code or other redemption mechanism displayed within the App.

3.3 Printed vouchers, screenshots, photographs, screen recordings, copied images or saved files will not be accepted under any circumstances.

3.4 Customers must be able to display the live voucher within the Fishkeeper App at the point of sale.

3.5 Promotions cannot be applied retrospectively after payment has been completed.

3.6 Promotions must be redeemed at the point of sale before the transaction is completed.

4. Where promotions can be redeemed

4.1 Unless otherwise stated, App Promotions are valid only at participating Maidenhead Aquatics stores within the United Kingdom.

4.2 App Promotions are not valid for online purchases unless specifically stated within the promotion.

4.3 Selected promotions may be available only at specific stores, within certain geographic regions, to selected customer groups, or to specific Fishkeeper App account holders. Any such restrictions will be identified within the promotion.

4.4 Store opening hours may vary. Customers should check local store opening times before making a special journey.

5. Promotion validity

5.1 Each promotion will display its validity period within the Fishkeeper App.

5.2 Promotions must be redeemed before the stated expiry date and time.

5.3 Expired vouchers cannot be redeemed, reinstated or extended.

5.4 Once expired, vouchers may be removed from the Fishkeeper App without notice.

6. Usage limits

6.1 Unless otherwise stated, each App Promotion may be redeemed once per customer account.

6.2 Promotions are intended for personal use only.

6.3 Promotions may not be copied, transferred, sold, exchanged, gifted or otherwise distributed.

6.4 Maidenhead Aquatics reserves the right to limit quantities purchased under any promotion.

6.5 Redemption limits may vary between promotions and will be displayed within the Fishkeeper App where applicable.

7. Combining promotions

7.1 App Promotions cannot be used in conjunction with any other offer, voucher, discount, coupon, promotional code, loyalty reward, price match or other promotional incentive unless expressly stated otherwise.

7.2 Multiple App Promotions may be redeemed in a single transaction only where they apply to different products and where the till system permits.

7.3 Where more than one discount applies to the same product, only the best available offer will be applied.

8. Product exclusions

8.1 Certain products may be excluded from App Promotions.

8.2 Excluded products may include, but are not limited to:

• Gift cards
• Live animals where prohibited by law or company policy
• Services
• Clearance items
• Selected brands or product categories
• Subscription products
• Charity products
• Any items specifically identified as excluded

8.3 Product exclusions may vary between promotions and will be detailed where applicable.

9. Stock availability

9.1 All promotions are subject to availability.

9.2 App Promotions are available while stocks last.

9.3 Maidenhead Aquatics does not guarantee the availability of any product during a promotional period.

9.4 Maidenhead Aquatics reserves the right to withdraw, amend or end a promotion early where allocated promotional stock has been exhausted.

9.5 No rain checks, substitutions or alternative discounts will be offered where promotional products are unavailable.

10. Returns and refunds

10.1 If products purchased using an App Promotion are returned, refunds will be based on the actual price paid after any promotional discount has been applied.

10.2 Promotional discounts cannot be transferred to replacement products.

10.3 If a promotion remains valid at the time of repurchase, a new transaction may be made using the original voucher, subject to the promotion's redemption limits and terms.

10.4 Refunds remain subject to Maidenhead Aquatics' standard returns policy and your statutory rights.

11. Fraud and misuse

11.1 Maidenhead Aquatics reserves the right to refuse redemption of any promotion where there is reason to believe:

• The voucher has been copied or duplicated.
• The voucher has been altered or tampered with.
• The voucher has been shared with unauthorised users.
• The promotion has been obtained through unauthorised means.
• Fraudulent, abusive or suspicious activity has occurred.

11.2 Maidenhead Aquatics may suspend or terminate access to promotions where misuse is suspected.

11.3 Any attempt to manipulate, exploit, automate or interfere with the operation of the Fishkeeper App, promotional offers or redemption process may result in the withdrawal of promotional benefits, suspension of account access and exclusion from future promotions.

12. Technical requirements

12.1 Customers must have:

• A compatible smartphone or tablet device.
• A current version of the Fishkeeper App.
• Internet access where required to load and display promotions.

12.2 Customers are responsible for maintaining their device, software and connectivity.

12.3 Maidenhead Aquatics is not responsible for failed redemptions resulting from:

• Device failure.
• Low battery.
• Lost or stolen devices.
• Internet connectivity issues.
• App software issues outside its reasonable control.
• Third-party service interruptions.

12.4 Access to promotions cannot be guaranteed at all times.

13. Errors and omissions

13.1 Maidenhead Aquatics reserves the right to correct pricing errors, product description errors, technical issues or other inaccuracies at any time.

13.2 Where an error affects a promotion, Maidenhead Aquatics may amend, suspend or withdraw the promotion without liability.

13.3 If a promotion is displayed with an incorrect price, discount, product description or other error, Maidenhead Aquatics reserves the right to correct or withdraw the offer.

14. Changes to promotions and terms

14.1 Maidenhead Aquatics reserves the right to:

• Amend these Terms and Conditions.
• Modify promotional mechanics.
• Change eligibility requirements.
• Change participating stores.
• Change qualifying products.
• Withdraw promotions without notice.

14.2 Any changes will take effect immediately upon publication within the Fishkeeper App or on the Maidenhead Aquatics website.

15. Liability

15.1 Nothing in these Terms and Conditions excludes or limits any rights that cannot be excluded under applicable law.

15.2 To the fullest extent permitted by law, Maidenhead Aquatics shall not be liable for any indirect, incidental, special or consequential loss arising from:

• Use of the Fishkeeper App.
• Inability to access promotions.
• Technical failures.
• Withdrawal or cancellation of promotions.

16. Privacy

16.1 Use of the Fishkeeper App is subject to the Fishkeeper App Privacy Policy.

16.2 By using the App, customers acknowledge and agree that personal information may be collected, processed and used in accordance with the Privacy Policy.

17. General

17.1 These Terms and Conditions are governed by the laws of England and Wales.

17.2 Any disputes arising in connection with App Promotions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17.3 These Terms and Conditions do not affect your statutory rights.

17.4 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

17.5 A failure by Maidenhead Aquatics to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision or any other rights.
